Other
Other nitrogen heterocyclic compounds (residual organic chemicals)
HSN 2933 99 90 covers residual nitrogen-heterocyclic compounds subject to a layered regulatory regime: the Central Insecticides Board and Registration Committee (CIB&RC) requires registration and an import permit for substances scheduled under the Insecticides Act, 1968, while the Narcotic Drugs and Psychotropic Substances (NDPS) framework mandates an import certificate for scheduled psychotropic and narcotic substances under Chapter VII-A of the NDPS Rules, 1985. The Ministry of Health and Family Welfare (MOHFW) has also issued a prohibition on chloramphenicol, nitrofurans, and their formulations for use in food-producing animal rearing systems under S.O. 1158(E) dated 12-03-2025. DGFT and CBIC policy conditions, including a Minimum Import Price condition on ATS-8 and mandatory Chapter 29 qualifiers, apply as additional customs-clearance overlays.
- Registration and import permit from CIB&RC
- Import certificate from NDPS
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Before filing the bill of entry, determine whether the specific substance falls within the Schedule to the Insecticides Act, 1968. If so, obtain registration and an import permit from the Secretariat of CIB&RC; import of scheduled insecticides is also restricted to ports notified under Rule 45 of the Insecticides Rules, 1971. Note that import of benomyl and triazophos is completely banned under S.O. 3951(E) dated 08-08-2018.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · S.O. 3951(E) dated 08-08-2018
- 2If the substance is a scheduled NDPS — including 4F-MDMB-BINACA, flualprazolam, phenazepam, zolpidem, butonitazene, bromazolam, or related salts/preparations — an import certificate is required for medical or scientific use under Chapter VII-A of the NDPS Rules, 1985. For other permitted NDPS imports, comply with ITC (HS) Schedule Appendix-I and policy condition 2 of Chapter 29. These requirements do not apply to remdesivir injection, remdesivir API, and beta cyclodextrin (SBEbCD).NDPS Rules, 1985 — Chapter VII-A · ITC (HS) policy condition 2, Chapter 29 · DGFT Notification 50/2025-26 dated 18-12-2025
- 3Ensure compliance with CBIC Circular 23/2023-Cus dated 30-09-2023 by including mandatory additional qualifiers in the import declaration for all Chapter 29 commodities, as stipulated in paragraphs 4.1 and 4.2 with effect from 15-10-2023. Additionally, verify whether the ATS-8 MIP condition (CIF value not less than US$ 111 per kg, Restricted until 30-09-2026) and Chapter 29 policy condition 8 (operative until 30-11-2026) are applicable to the specific substance being imported.CBIC Circular 23/2023-Cus dated 30-09-2023 · DGFT Notification 50/2025-26 dated 18-12-2025 · ITC (HS) policy condition 8, Chapter 29
The most common error on this tariff line is treating the residual 'Other' classification as a catch-all free-import entry and failing to screen the specific chemical identity against the Insecticides Act Schedule, the NDPS scheduled-substance list, and the MOHFW prohibition on chloramphenicol and nitrofurans before filing the bill of entry. A substance that clears customs documentation on the Chapter 29 qualifiers alone but lacks the CIB&RC import permit or NDPS import certificate is liable to seizure and confiscation; the remdesivir/SBEbCD exemption is substance-specific and does not extend to the broader CTI.
