Goods specified in Supplementary Note 15 to this Chapter

Nitrogen heterocyclic compounds under Supplementary Note 15, Chapter 29

CDSCO CLEARANCE · CIB&RC CLEARANCE · +3 OTHER PGAS

HSN 2933 59 50 covers goods specified in Supplementary Note 15 to Chapter 29 and is subject to Central Drugs Standard Control Organisation (CDSCO) registration where listed as a medical device under G.S.R. 102(E) dated 11-02-2020, and to mandatory registration or import permit from the Central Insecticides Board and Registration Committee (CIB&RC) under Section 9 of the Insecticides Act, 1968 where the substance is a listed insecticide. Ministry of Health and Family Welfare (MOHFW), Narcotic Drugs and Psychotropic Substances (NDPS) controls, ozone-depleting-substance restrictions, and CBIC Chapter 29 mandatory qualifier requirements apply as additional clearance overlays.

Compliance steps
  1. 1
Determine the end-use classification of the substance before filing the bill of entry. Where it is a listed medical device under G.S.R. 102(E) dated 11-02-2020, obtain CDSCO registration as a precondition to import. Where it is a listed insecticide under the Insecticides Act, 1968, obtain either a certificate of registration or an import permit from the CIB&RC Registration Committee under Section 9 of that Act; import from any source not specified on the certificate or permit attracts seizure.
    Section 9 of the Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · G.S.R. 102(E) dated 11-02-2020 (MOHFW) · CBIC Circulars 35/2011-Cus dated 09-08-2011 and 7/2014-Cus dated 07-03-2014
  2. 2
Submit mandatory additional qualifiers in the import declaration for all commodities under Chapter 29, as required under paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15 October 2023. Non-submission of qualifiers causes bill-of-entry rejection and consignment detention.

  3. 3
Where the substance is a narcotic drug or psychotropic substance, comply with ITC (HS) policy conditions 2 and 3 of Chapter 29. Where it is a hazardous substance imported in quantities exceeding the specified threshold, obtain an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992; ozone-depleting substances are additionally subject to policy conditions 1, 4, and 5 of Chapter 29 and the Ozone Depleting Substances (Regulation and Control) Rules, 2000.

A word of counsel

The single most common error on this tariff line is treating the ITC (HS) 'Free' import status — confirmed by DGFT Notification 45/2025-26 — as clearing all downstream PGA obligations. The 'Free' designation governs the DGFT policy condition only; it does not displace CIB&RC registration or permit requirements, CDSCO registration for medical-device sub-categories, or NDPS controls. A consignment of a listed insecticide or scheduled psychotropic arriving without the relevant CIB&RC or NDPS authorisation is liable to confiscation and prosecution regardless of its 'Free' tariff status.

Frequently asked
Does HSN 2933 59 50 require BIS certification?
No. No BIS Quality Control Order covers goods classified under Supplementary Note 15 to Chapter 29. Import is governed primarily by CDSCO registration under G.S.R. 102(E) dated 11-02-2020 where the product is a listed medical device, and by CIB&RC registration or permit under Section 9 of the Insecticides Act, 1968 where it is a listed insecticide.
Is an import permit required even when the insecticide is not used for pesticidal purposes?
Yes. Under Section 9 of the Insecticides Act, 1968 and Rule 45 of the Insecticides Rules, 1971, an import permit from the CIB&RC Registration Committee is required even for non-insecticidal end-use; the permit will specify the permitted source, and import from any other source is prohibited.
What additional declaration is required at the bill-of-entry stage for Chapter 29 commodities?
Mandatory additional qualifiers as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023 must be included in every import declaration for Chapter 29 commodities with effect from 15 October 2023; failure to include them causes bill-of-entry rejection.
