    If the substance falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of CIB&RC before import. The consignment must enter only through ports notified under Rule 45 of the Insecticides Rules, 1971; diversion to any non-notified port renders the consignment liable to seizure.

    Upload in e-Sanchit the Certificate of Analysis — Drug (0010dc), Batch Release Certificate (0030dc), Label of Consignment (0110dc), Registration Certificate (Drugs) (101dc1) and Import Licence for Drugs (9111dc) before customs out-of-charge. Also ensure mandatory Chapter 29 additional qualifiers are declared in the import declaration per CBIC Circular 23/2023-Cus, operative from 15 October 2023.

A word of counsel

The most frequent error on this tariff line is treating the NDPS import certificate as the sole clearance and overlooking the independent CIB&RC registration-and-permit requirement when the substance also appears in the Schedule to the Insecticides Act, 1968. Both regimes operate in parallel: a current NDPS certificate does not satisfy the CIB&RC licensing obligation, and a consignment lacking the CIB&RC permit at a non-notified port faces confiscation under the Insecticides Rules, 1971, irrespective of the NDPS compliance status. Additionally, importers of specified hazardous substances exceeding prescribed quantities must hold a public liability insurance policy under the Public Liability Insurance Act, 1991 as notified by S.O. 227(E) dated 24-03-1992.
