Other derivatives of malonylurea (barbituric acid); salts thereof
Barbituric acid derivatives, malonylurea salts (barbiturates)
HSN 2933 54 00 (other derivatives of malonylurea/barbituric acid and salts thereof) is subject to Narcotic Drugs and Psychotropic Substances (NDPS) import certificate requirements under Chapter VII-A and Rule 53 of the NDPS Rules, 1985, for medical and scientific purposes; other imports are governed by Appendix-I of the ITC (HS) Schedule under policy condition 2 of Chapter 29. Where any substance in this tariff line figures in the Schedule to the Insecticides Act, 1968, registration and import permit from the Central Insecticides Board and Registration Committee (CIB&RC) under Rule 45 of the Insecticides Rules, 1971 applies as an additional overlay.
- Import certificate from NDPS
- Registration certificate from CIB&RC
- Import permit from CIB&RC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1For medical or scientific imports, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 from the Narcotics Commissioner (details at cbn.nic.in). For all other imports, confirm the substance is permitted under Appendix-I of the ITC (HS) Schedule per ITC (HS) policy condition 2 of Chapter 29 before filing the bill of entry.Chapter VII-A and Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2, Chapter 29
- 2If the specific substance falls within the Schedule to the Insecticides Act, 1968, obtain a registration certificate and import permit from the secretariat of CIB&RC, and route the consignment only through the ports specified under Rule 45 of the Insecticides Rules, 1971. Upload all mandatory documents — certificate of analysis (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc) — in e-Sanchit before out-of-charge.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · e-Sanchit document codes 0010dc, 0030dc, 0110dc, 101dc1, 9111dc
- 3Ensure the import declaration includes the mandatory additional qualifiers for Chapter 29 commodities in compliance with CBIC Circular 23/2023-Cus dated 30-09-2023, applicable from 15 October 2023. Where the import quantity of a specified hazardous substance exceeds the prescribed threshold, take out an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023, Para 4.1 and 4.2 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is assuming that a drugs-regime document set (certificate of analysis, batch release certificate, import licence for drugs) is sufficient without separately determining whether the substance is also scheduled under the Insecticides Act, 1968. A substance can simultaneously attract the NDPS import certificate requirement and the CIB&RC registration-and-permit requirement; presenting only one PGA clearance at the bill of entry results in detention and denial of out-of-charge until the second PGA's documentation is uploaded in e-Sanchit.
