Fentanyl derivatives and related opioid compounds
HSN 2933 34 00 (Other fentanyls and their derivatives) is subject to a No Objection Certificate (NOC) from the Narcotics Commissioner, Gwalior, under ITC (HS) policy condition no. 3 to Chapter 29, administered by the Directorate General of Foreign Trade (DGFT) per DGFT Notification 39/2015-2020 dated 03-10-2018. Where any substance falling under this tariff line is listed in the Schedule to the Insecticides Act, 1968, registration and an import permit from the Central Insecticides Board and Registration Committee (CIB&RC) are additionally required, and import is restricted to notified ports under Rule 45 of the Insecticides Rules, 1971. The dual-regime trap on this tariff line is the most frequent cause of consignment detention: importers who secure the Narcotics Commissioner NOC routinely overlook that a fentanyl derivative listed in the Schedule to the Insecticides Act, 1968 simultaneously triggers independent CIB&RC registration and an import permit, with port-of-entry restricted to CIB&RC-notified locations. A valid NOC from Gwalior does not cure the absence of a CIB&RC permit, and the two clearances are assessed independently at the bill of entry — missing either one exposes the consignment to seizure under the respective statute.
