Phencyclidine (PCP) and its salts, narcotic psychotropic substance
HSN 2933 33 27 (Phencyclidine (INN) (PCP) and its salt) is subject to Narcotic Drugs and Psychotropic Substances (NDPS) controls, requiring an import certificate for medical or scientific use under Chapter VII-A of the NDPS Rules, 1985, with a No Objection Certificate from the Narcotics Commissioner, Gwalior, mandatory before import. Where the substance falls within the Schedule to the Insecticides Act, 1968, registration and a permit from the Central Insecticides Board and Registration Committee (CIB&RC) are additionally required, and import is restricted to notified places under Rule 45 of the Insecticides Rules, 1971. - 2If the substance falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of CIB&RC and route the consignment only through places notified under Rule 45 of the Insecticides Rules, 1971. - 3Within 30 days of import, notify consignment details to the National Authority, Chemical Weapons Convention (Cabinet Secretariat), Ministry of External Affairs (DANDISA), Department of Chemicals and Petrochemicals, and DGFT, and submit a copy of the bill of entry to DGFT. The dual-track structure of this tariff line is the most common source of detention: importers obtaining the CIB&RC registration for the insecticide-schedule pathway routinely overlook that the NDPS NOC from the Narcotics Commissioner, Gwalior, is a separate and prior requirement for the psychotropic-substance pathway, and the two clearances are not substitutes for each other. Additionally, where import quantities of specified hazardous substances exceed thresholds under the Public Liability Insurance Act, 1991, an insurance policy must be taken out per S.O. 227(E) dated 24-03-1992 — failure to do so is an independent statutory violation separate from the NDPS and CIB&RC clearances.
