- 1Obtain a No Objection Certificate from the Narcotics Commissioner, Gwalior, before filing the bill of entry. This NOC is a pre-import requirement and customs out-of-charge will not be granted without it. If the substance also figures in the Schedule to the Insecticides Act, 1968, obtain the CIB&RC registration and import permit before shipment and verify that the designated import port complies with Rule 45 of the Insecticides Rules, 1971.DGFT Notification 54/2015-20 dated 09-02-2022 · Rule 45 of the Insecticides Rules, 1971 · Insecticides Act, 1968
- 2Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by including all mandatory additional qualifiers in the import declaration for Chapter 29 commodities, effective 15-10-2023, as stipulated in paragraphs 4.1 and 4.2 of that circular. Declarations lacking the required qualifiers will be flagged for examination and may result in consignment detention.CBIC Circular 23/2023-Cus dated 30-09-2023, paras 4.1 and 4.2
- 3Within 30 days of import, notify the details of each consignment to the National Authority, Chemical Weapons Convention (Cabinet Secretariat), the Ministry of External Affairs (DANDISA), the Department of Chemicals and Petrochemicals, and DGFT, and submit a copy of the bill of entry to DGFT. For imports of specified hazardous substances exceeding prescribed quantities, take out an insurance policy under the Public Liability Insurance Act, 1991.DGFT Notification 54/2015-20 dated 09-02-2022 · ITC (HS) Chapter 29 Policy Condition 3 · S.O. 227(E) dated 24-03-1992, Ministry of Environment and Forests
The most common error on this tariff line is dispatching the consignment before the Narcotics Commissioner's NOC is in hand, on the assumption that bezitramide's 'Free' ITC (HS) status means unconditional entry. The 'Free' designation applies only to trade-policy licensing — the pre-import NOC from the Narcotics Commissioner and, where applicable, the CIB&RC permit are independent statutory requirements whose absence triggers seizure under the Narcotic Drugs and Psychotropic Substances Act, 1985 and detention at the port of import, regardless of the bill of entry status.
