Safrole
Safrole, a controlled heterocyclic oxygen compound
HSN 2932 94 00 (Safrole) is subject to consignment-wise No Objection Certificate requirement from the Narcotics Commissioner under the NDPS Controlled Substances Order dated 26 March 2013, administered by the Narcotic Drugs and Psychotropic Substances (NDPS) authority, covering safrole and any essential oil containing 4% or more safrole. Where safrole falls within the Schedule to the Insecticides Act, 1968, registration and a import permit from the Central Insecticides Board and Registration Committee (CIB&RC) are also required, with import restricted to notified places under Rule 45 of the Insecticides Rules, 1971. Mandatory Chapter 29 additional qualifiers under CBIC Circular 23/2023-Cus apply at the bill-of-entry stage.

- 2If the consignment is classified as a pesticide under the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of the Central Insecticides Board and Registration Committee and route the consignment only through places notified under Rule 45 of the Insecticides Rules, 1971. - 3Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by including mandatory additional qualifiers in the import declaration for Chapter 29 commodities, as stipulated in paragraphs 4.1 and 4.2, with effect from 15 October 2023. The most common error on this tariff line is treating the NDPS NOC and the CIB&RC regime as mutually exclusive, when in practice both may apply simultaneously to the same consignment — the NDPS NOC governs safrole as a controlled substance, while the CIB&RC registration and restricted-port regime kicks in where safrole is scheduled as a pesticide under the Insecticides Act, 1968. A consignment that secures the Narcotics Commissioner's NOC but arrives at a non-notified port without CIB&RC clearance remains liable to seizure and detention under the Insecticides Rules, 1971, irrespective of the NDPS compliance.
