Where the goods are listed medical devices under G.S.R. 102(E) dated 11-02-2020, obtain CDSCO registration as a condition of import. Where the goods are listed insecticides under Section 3(e) of the Schedule to the Insecticides Act, 1968, obtain a certificate of registration or, for non-insecticidal end use, an import permit from the CIB&RC under Section 9 of the Insecticides Act, 1968; import is restricted to the source specified on the certificate or permit.

    Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by furnishing mandatory additional qualifiers in the import declaration for all commodities under Chapter 29 as stipulated in Paras 4.1 and 4.2, with effect from 15 October 2023. Failure to provide the specified qualifiers will result in bill-of-entry deficiency and detention at the port.

    Where the consignment constitutes hazardous substances exceeding specified quantities, obtain an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992 issued by the Ministry of Environment, Forest and Climate Change. If the goods are narcotic drugs or psychotropic substances, comply with policy conditions 2 and 3 of Chapter 29 as applicable to the specific substance.

The most common error on this tariff line is treating the end-use determination as a post-clearance exercise. The regulatory track — CDSCO registration, CIB&RC registration, or NDPS policy compliance — must be identified and documented before the bill of entry is filed, because the source-of-import restriction on the CIB&RC certificate means that a last-minute supplier change after registration renders the permit invalid and the consignment subject to seizure under the Insecticides Act, 1968. Importers should also confirm that the CBIC Chapter 29 mandatory qualifiers are complete in the import declaration from 15 October 2023 onwards, as deficiency in qualifiers is treated as a declaration defect independent of PGA clearance.
