Amino-compounds with oxygen function, residual category
HSN 2922 50 90 (amino-alcohol-phenols, amino-acid-phenols and other amino-compounds with oxygen function, other) is subject to overlapping PGA controls: the Central Insecticides Board and Registration Committee (CIB&RC) requires registration and an import permit for substances falling in the schedule to the Insecticides Act, 1968, while import of scheduled narcotic or psychotropic substances such as tramadol and methoxetamine requires authorisation from the Narcotics Commissioner under the Narcotic Drugs and Psychotropic Substances Act, 1985. A Minimum Import Price of US$ 111 per kilogram applies to ATS-8 imports until 30 September 2026 under DGFT Notification 30/2025-26, and CBIC Circular 23/2023-Cus mandates Chapter 29 additional qualifiers in the import declaration.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Import certificate from NDPS
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1If the imported substance is listed in the schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of the Central Insecticides Board and Registration Committee before shipment. Import of scheduled insecticides is restricted to notified places of import under Rule 45 of the Insecticides Rules, 1971; file bill of entry only at a permitted port.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971
- 2If the substance is classified as a narcotic drug or psychotropic substance — including tramadol (per S.O. 1761(E) dated 26-04-2018) or methoxetamine/MXE — obtain authorisation from the Narcotics Commissioner under Chapter VII-A of the NDPS Rules, 1985 for medical or scientific use, or comply with ITC (HS) Appendix-I and policy condition 2 to Chapter 29 for other permissible use. Upload the import certificate in e-Sanchit.NDPS Act, 1985 · NDPS Rules, 1985, Chapter VII-A · Gazette Notification S.O. 1761(E) dated 26-04-2018 · ITC (HS) policy condition 2 to Chapter 29
- 3Upload all mandatory e-Sanchit documents before out-of-charge: certificate of analysis — drug (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate (drugs) (101dc1), and import licence for drugs (9111dc). Ensure the bill of entry carries the Chapter 29 mandatory additional qualifiers per paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus, effective 15 October 2023. For ATS-8 imports with CIF value below US$ 111 per kilogram, the Restricted-import status applies until 30 September 2026 unless the importer holds Advance Authorisation, EOU, or SEZ status with no DTA sale of inputs.CBIC Circular 23/2023-Cus dated 30-09-2023 · DGFT Notification 30/2025-26 dated 18-09-2025
The most common error on this tariff line is treating import as unconditionally free because the general ITC (HS) policy for this CTI is 'Free', while overlooking that three discrete sub-regimes — CIB&RC scheduled-insecticide controls, NDPS authorisation for tramadol or methoxetamine, and the ATS-8 MIP restriction — operate as independent overlays. A consignment that clears one regime but not another is liable to detention and, for NDPS substances, confiscation and criminal prosecution under the NDPS Act, 1985; verifying the precise chemical identity against all three schedules before filing the bill of entry is therefore essential, not optional.
