CIB&RC CLEARANCE · NDPS CLEARANCE

HSN 2922 19 90 (other amino-compounds with oxygen function) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968 where the substance falls within the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate requirements apply under Chapter VII-A of the NDPS Rules, 1985 where the substance is a scheduled narcotic or psychotropic, and Category 1B chemical controls under the Chemical Weapons Convention Act and ITC (HS) policy condition 3 of Chapter 29 govern specific amino-alcohol precursors.

Compliance steps
  1. 1
Where the imported substance appears in the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before dispatch. Import is restricted to places notified under Rule 45 of the Insecticides Rules, 1971; unnotified ports attract consignment detention.

  2. 2
Upload all mandatory documents in e-Sanchit at the bill of entry: certificate of analysis — drug (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc). Additionally, comply with the mandatory Chapter 29 additional qualifiers in the import declaration as required under CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15 October 2023.
    CBIC Circular 23/2023-Cus dated 30-09-2023, Para 4.1 and 4.2
  3. 3
If the substance is a Category 1B chemical (N,N-dialkyl aminoethane-2-ols and protonated salts, excluding N,N-dimethylaminoethanol and N,N-diethylaminoethanol), restrict sourcing to State Parties to the Chemical Weapons Convention and, within 30 days of import, notify consignment details to the National Authority CWC, Ministry of External Affairs (D&ISA), Department of Chemicals and Petrochemicals, and DGFT, and submit a copy of the bill of entry to DGFT. If the substance is a scheduled NDPS, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 before shipment.

A word of counsel

The most common error on this tariff line is filing a single-track bill of entry without checking whether the specific substance simultaneously triggers CIB&RC registration, NDPS import-certificate requirements, and CWC Category 1B post-import notification — all of which can apply concurrently to different substances falling under the same residual 8-digit code. Failure to submit the CWC post-import notification to all four designated authorities within the 30-day window is an independent contravention of the CWC Act, distinct from any customs or NDPS violation, and does not become rectifiable after the window closes.

Frequently asked
Does HSN 2922 19 90 require BIS certification?
No. No BIS Quality Control Order covers residual oxygen-function amino-compounds under this tariff line. Import is governed by CIB&RC under the Insecticides Act, 1968 where the substance is a scheduled pesticide, with concurrent NDPS and CWC Category 1B controls where those schedules are triggered.
Which e-Sanchit document codes are mandatory at the bill of entry for this CTI?
The mandatory documents are: certificate of analysis — drug (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc), all to be uploaded in e-Sanchit before customs out-of-charge.
Is the CWC Category 1B post-import notification obligation waived if the importer holds a CIB&RC permit?
No. The CWC post-import notification to the National Authority CWC, Ministry of External Affairs, Department of Chemicals and Petrochemicals, and DGFT — along with submission of the bill of entry copy to DGFT within 30 days — is a separate obligation under the CWC Act and ITC (HS) policy condition 3 of Chapter 29, independent of any pesticide-registration or import-permit held under the Insecticides Act, 1968.
