CDSCO CLEARANCE · CIB&RC CLEARANCE · +1 OTHER PGAS

HSN 2922 19 19 (residual oxygen-function amino-compounds) is subject to Central Drugs Standard Control Organisation (CDSCO) registration requirements under G.S.R. 102(E) dated 11-02-2020 for any substance classified as a medical device, and to Central Insecticides Board and Registration Committee (CIB&RC) registration or import-permit requirements under the Insecticides Act, 1968 where the substance is intended for insecticidal use. The tariff line is designated Free under DGFT Notification 44/2025-26 dated 15-10-2025, subject to Chemical Weapons Convention (CWC) Schedule-2 notification obligations for 2-hydroxy N,N-diisopropyl ethylamine and mandatory Chapter 29 qualifier declarations under CBIC Circular 23/2023-Cus.

Compliance steps
  1. 1
If the amino-compound is a medical device listed in G.S.R. 102(E) dated 11-02-2020, obtain CDSCO registration prior to import and ensure all conditions specified in that notification are met. If the substance is intended for insecticidal, fungicidal, herbicidal, or rodenticidal use, secure CIB&RC registration or, for non-insecticidal research purposes, a CIB&RC import permit; import only from the source specified on the certificate or permit.
    G.S.R. 102(E) dated 11-02-2020 (MOHFW/CDSCO) · Section 9 of the Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · CBIC Circulars 35/2011-Cus dated 09-08-2011 and 7/2014-Cus dated 07-03-2014
  2. 2
Submit mandatory additional qualifiers in the import declaration as required under CBIC Circular 23/2023-Cus dated 30-09-2023, paragraphs 4.1 and 4.2, for all commodities under Chapter 29, with effect from 15-10-2023. Upload all applicable PGA clearance documents in e-Sanchit before filing the bill of entry.
    CBIC Circular 23/2023-Cus dated 30-09-2023, paras 4.1 and 4.2
  3. 3
If the specific substance being imported is 2-hydroxy N,N-diisopropyl ethylamine (a Category 1B, Schedule-2 CWC chemical), import only from State Parties to the Chemical Weapons Convention and, within 30 days of import, notify the National Authority CWC (Cabinet Secretariat, Ministry of External Affairs), the Department of Chemicals and Petrochemicals, and DGFT, submitting a copy of the bill of entry to DGFT within that same 30-day window.

A word of counsel

The most persistent error on this residual tariff line is assuming that a Free ITC (HS) policy status under DGFT Notification 44/2025-26 eliminates all PGA obligations. In practice, the operative compliance burden is substance-specific: the same 8-digit code can simultaneously trigger CDSCO device registration, CIB&RC insecticide registration, and CWC Schedule-2 post-import notification — each with independent consequences for detention, confiscation, or prosecution — depending solely on what the imported molecule is and its intended use.

Frequently asked
Does HSN 2922 19 19 require BIS certification?
No; no BIS Quality Control Order covers residual oxygen-function amino-compounds under this tariff line. Import compliance is governed by CDSCO under G.S.R. 102(E) dated 11-02-2020 for medical-device-classified substances, by CIB&RC under the Insecticides Act, 1968 for insecticidal-use substances, and by DGFT CWC Schedule-2 notification obligations where applicable.
Is the CIB&RC import permit required even when the amino-compound is not being used as an insecticide?
Yes. Where the substance falls under the Insecticides Act, 1968 but is being imported for a non-insecticidal purpose, an import permit from the CIB&RC Registration Committee is still mandatory, and import is restricted to designated places per Rule 45 of the Insecticides Rules, 1971.
What happens if the 30-day CWC notification for 2-hydroxy N,N-diisopropyl ethylamine is missed?
Failure to notify the National Authority CWC, the Department of Chemicals and Petrochemicals, and DGFT within 30 days of import, or to submit the bill of entry copy to DGFT within that window, constitutes a breach of the CWC Schedule-2 import conditions under Appendix II to Schedule I of the ITC (HS) Import Policy, exposing the importer to DGFT enforcement action.
