Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a certificate of registration or an import permit from the Central Insecticides Board and Registration Committee before the bill of entry is filed. Where ethafluralin is imported for a non-insecticidal purpose, a separate import permit from the Registration Committee under the Department of Agriculture and Cooperation is required; import from any source not specified on the registration certificate or permit is prohibited.Section 9 of the Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · CBIC Circulars 35/2011 dated 09-08-2011 and 7/2014 dated 07-03-2014
- 2Ensure compliance with CBIC Circular 23/2023-CUS dated 30-09-2023 by including mandatory additional qualifiers in the import declaration for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2, with effect from 15-10-2023. Confirm compliance with ITC (HS) policy condition 7 of Chapter 29 per DGFT Notification 44/2025-26 dated 15-10-2025 and the Finance Bill 2025 provisions effective 01-05-2025.CBIC Circular 23/2023-CUS dated 30-09-2023 · DGFT Notification 44/2025-26 dated 15-10-2025
- 3Where the import quantity exceeds the specified thresholds for hazardous substances, take out a public liability insurance policy as required under the Public Liability Insurance Act, 1991. If the consignment involves ozone-depleting substances or narcotic/psychotropic substances falling under this chapter, ensure compliance with policy conditions 1, 4, and 5 of Chapter 29 and conditions 2 and 3 as applicable respectively.S.O. 227(E) dated 24-03-1992 by MoEFCC · Ozone Depleting Substances (Regulation and Control) Rules, 2000 · ITC (HS) Chapter 29 General Notes para 8(a) and 8(b)
The most common error on this tariff line is importing ethafluralin against a registration certificate that specifies a different source of supply — even a valid CIB&RC certificate does not authorise import from an unlisted supplier, and a source mismatch renders the consignment liable to detention and confiscation at the port of import under the Insecticides Act, 1968. The port restriction under Rule 45 of the Insecticides Rules, 1971 compounds the risk: a consignment arriving at an unspecified port faces a separate contravention independent of the registration status.
