Para nitroaniline
Para-nitroaniline, aniline derivatives and their salts
HSN 2921 42 26 (Para nitroaniline) is subject to registration and import permit requirements from the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act, with import restricted to notified places under Rule 45 of the Insecticides Rules, 1971. Narcotic Drugs and Psychotropic Substances (NDPS) conditions apply where the substance is governed by Chapter VII-A of the NDPS Rules, 1985, and the Directorate General of Foreign Trade (DGFT) ITC (HS) policy overlays on Chemical Weapons Convention controls apply as additional clearance requirements.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Confirm whether para-nitroaniline figures in the Schedule to the Insecticides Act, 1968; if so, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Import is permitted only at places notified under Rule 45 of the Insecticides Rules, 1971 — diversion to a non-notified port will ground the consignment.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition, Chapter 29
- 2Where the substance is also governed by the NDPS regime, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for imports under the special provisions for medical and scientific purposes (Chapter VII-A). Imports outside that category are governed by Appendix I to the ITC (HS) Schedule per ITC (HS) policy condition 2 to Chapter 29.Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 to Chapter 29
- 3File mandatory additional qualifiers in the import declaration as required under CBIC Circular 23/2023-Cus dated 30-09-2023 for commodities under Chapter 29, effective 15 October 2023. If the consignment of specified hazardous substances exceeds the specified threshold quantities, take out a public liability insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is treating the CIB&RC Schedule check as a formality. Para-nitroaniline can serve as a pesticide intermediate, and if customs officers classify the consignment as a Schedule-listed insecticide at the bill-of-entry stage without a current CIB&RC registration and permit on file, the consignment faces detention and possible confiscation under the Insecticides Act, 1968 — regardless of the Chapter 29 qualifier compliance already uploaded in e-Sanchit.
