Amino salicylate
Amino salicylate, esters of salicylic acid and salts
HSN 2918 23 20 (Amino salicylate) is subject to concurrent oversight by the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act, and by the Narcotic Drugs and Psychotropic Substances (NDPS) framework under Chapter VII-A of the NDPS Rules, 1985 for medical and scientific import. The Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 and mandatory Chapter 29 declaration qualifiers under CBIC Circular 23/2023-Cus apply as additional clearance requirements.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Import certificate from NDPS
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where the amino salicylate formulation is scheduled under the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Note that import is restricted to notified places of import under Rule 45 of the Insecticides Rules, 1971; consignments arriving at non-notified ports are liable to detention and seizure.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2Where the consignment qualifies as an NDPS substance, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 before import; imports for medical and scientific purposes are governed by Chapter VII-A of those Rules. Imports outside that category are governed by Appendix-I to the ITC (HS) Schedule.Rule 53 and Chapter VII-A of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Upload all mandatory e-Sanchit documents before the bill of entry is given out-of-charge: certificate of analysis — drug (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc). Additionally, ensure the bill of entry carries the mandatory Chapter 29 additional qualifiers as stipulated in Paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus, effective 15 October 2023.CBIC Circular 23/2023-Cus dated 30-09-2023
The most common error on this tariff line is assuming that drug-regime document compliance (CIB&RC registration, e-Sanchit upload of codes 0010dc, 101dc1, 9111dc) exhausts the clearance obligation, while overlooking the NDPS import-certificate requirement under Rule 53 of the NDPS Rules, 1985 where the substance is scheduled — a distinct and parallel clearance that customs officers verify independently. A consignment held at an NDPS-facilitated gate without the Rule 53 certificate faces detention regardless of CIB&RC permit validity, and the port-of-import restriction under Rule 45 of the Insecticides Rules, 1971 must be confirmed against the bill of lading before vessel departure.
