Dibutyl phthalate, aromatic polycarboxylic acid ester plasticiser
HSN 2917 39 10 (Dibutyl phthalate) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act; import of insecticides is further restricted to designated ports under Rule 45 of the Insecticides Rules, 1971. Where the substance qualifies as an NDPS substance, import is additionally governed by Chapter VII-A of the Narcotic Drugs and Psychotropic Substances (NDPS) Rules, 1985, and the ITC (HS) policy condition 2 to Chapter 29 administered by the Directorate General of Foreign Trade (DGFT). The most common error on this tariff line is assuming that dibutyl phthalate, imported primarily as a plasticiser rather than a pesticide, falls outside the CIB&RC regime entirely. The Insecticides Act, 1968 captures substances by their Schedule listing, not by their end-use at import: if the specific formulation or grade is scheduled, CIB&RC registration and an import permit are mandatory regardless of the stated industrial application. A consignment arriving at a non-designated port without a CIB&RC permit is liable to seizure under the Insecticides Act irrespective of CBIC qualifier compliance.
