Compliance steps
  1. 1
Verify whether the specific ester to be imported figures in the Schedule to the Insecticides Act, 1968. If it does, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee, and confirm that the consignment is routed through a port at which insecticides may be imported under Rule 45 of the Insecticides Rules, 1971.

  2. 2
Where the ester is a scheduled NDPS substance, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for imports intended for medical or scientific purposes under Chapter VII-A of those Rules. Imports falling outside that category are governed by Appendix-I to the ITC (HS) Schedule and ITC (HS) policy condition 2 of Chapter 29.

  3. 3
File the bill of entry with the mandatory additional qualifiers for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15-10-2023. Where the consignment involves specified hazardous substances exceeding prescribed quantities, take out an insurance policy under the Public Liability Insurance Act, 1991 as required by S.O. 227(E) dated 24-03-1992.

A word of counsel

The most common error on this tariff line is assuming that neither the CIB&RC nor NDPS regime applies because the commercial description does not use the word 'pesticide' or 'narcotic'. The Schedule to the Insecticides Act, 1968 captures esters by chemical name, and a consignment arriving without CIB&RC registration when the substance is scheduled is liable to detention and confiscation at the designated import port — the port restriction under Rule 45 is absolute, not discretionary. Verify the scheduled status of the specific ester against both the CIB&RC Schedule and the NDPS Schedule before placing the purchase order.

Frequently asked
Does HSN 2916 39 50 require BIS certification?
No, no BIS Quality Control Order covers esters of aromatic monoacids. Import is governed by the Central Insecticides Board and Registration Committee under the Insecticides Act, 1968 where the substance is scheduled, and by the NDPS Rules, 1985 where the ester is a narcotic or psychotropic substance.
Are all esters under HSN 2916 39 50 subject to CIB&RC registration, or only certain ones?
Only esters that figure in the Schedule to the Insecticides Act, 1968 require CIB&RC registration and an import permit; those outside the Schedule are not subject to the Insecticides Rules port restriction under Rule 45 of the Insecticides Rules, 1971.
What happens if a scheduled NDPS ester is imported without the Rule 53 import certificate?
An import without a valid Rule 53 import certificate under the NDPS Rules, 1985 renders the consignment liable to seizure and prosecution under the Narcotic Drugs and Psychotropic Substances Act, 1985; there is no provision for post-arrival regularisation of a missing import certificate.
