The most common error on this residual tariff line is assuming that the absence of a known pesticide name in the consignment description clears CIB&RC scrutiny — the schedule to the Insecticides Act, 1968 is substance-specific, and customs officers will assess the declared chemical identity against the schedule at the restricted import points notified under Rule 45 of the Insecticides Rules, 1971. A consignment routed through an unnotified port or without prior CIB&RC registration is liable to detention and seizure regardless of NDPS or DGFT compliance. The Chapter 29 mandatory qualifiers under CBIC Circular 23/2023-Cus are a parallel, independent obligation and their absence at the bill-of-entry stage can delay out-of-charge even when all PGA clearances are in order.
