Esters of methacrylic acid
Esters of methacrylic acid, organic chemical intermediates
HSN 2916 14 00 (Esters of methacrylic acid) is subject to registration and import-permit requirements of the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Act, 1968 and Rule 45 of the Insecticides Rules, 1971, where any product under this tariff line figures in the Schedule to that Act. Where the substance is classified as a Narcotic Drug or Psychotropic Substance, an import certificate under Rule 53 of the NDPS Rules, 1985 is additionally required. The Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 and mandatory CBIC Chapter 29 qualifiers under CBIC Circular 23/2023-Cus apply as customs-level overlays.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Determine whether the specific ester of methacrylic acid figures in the Schedule to the Insecticides Act, 1968. If it does, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment, and route the consignment only through ports notified under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2If the substance is an NDPS-scheduled item, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for imports made under the special provision for medical and scientific purposes (Chapter VII-A of the NDPS Rules, 1985). All other NDPS imports are governed by Appendix-I to the ITC (HS) Schedule.Chapter VII-A and Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Submit mandatory additional qualifiers in the import declaration at the bill-of-entry stage as required for Chapter 29 commodities under paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, with effect from 15-10-2023. If the consignment involves specified hazardous substances exceeding prescribed quantities, take out a public-liability insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is failing to verify at the product-substance level whether the specific ester figures in the Schedule to the Insecticides Act, 1968 before shipment. CIB&RC registration and the port-restriction under Rule 45 of the Insecticides Rules, 1971 are triggered by the Schedule entry, not by the tariff heading alone — a consignment arriving at a non-notified port without a CIB&RC permit is liable to detention and confiscation regardless of whether CBIC Chapter 29 qualifiers have been filed correctly.
