Salts of formic acid, other than sodium or calcium formate
HSN 2915 12 90 (other salts of formic acid) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate requirements under Chapter VII-A and Rule 53 of the NDPS Rules, 1985 apply concurrently for any scheduled substance, and the Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 governs the broader import framework.
- Registration and permit from CIB&RC
- Import certificate from NDPS
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where the substance falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Note that importation of such insecticides is restricted to ports specified under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2Where the substance is a scheduled NDPS substance, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for imports under Chapter VII-A (medical and scientific purposes); imports outside that category are governed by Appendix-I to the ITC (HS) Schedule. Upload the certificate in e-Sanchit before the bill of entry is filed.Chapter VII-A and Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by including the mandatory additional qualifiers in the import declaration for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2, with effect from 15-10-2023. Where import of specified hazardous substances exceeds the quantities prescribed under S.O. 227(E) dated 24-03-1992, take out the required insurance policy under the Public Liability Insurance Act, 1991.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The dual-regime trap on this tariff line is assuming that a single clearance path applies: substances may simultaneously attract CIB&RC registration as a scheduled insecticide and the NDPS import-certificate requirement as a controlled precursor, and each regime has its own designated-port restriction or category limit. Importers who obtain only one clearance — typically the CIB&RC permit — and overlook the NDPS Rule 53 certificate expose the consignment to detention and criminal liability under the NDPS Act, 1985, not merely a customs penalty.
