Tembotrione
Tembotrione herbicide, organic chemical ketone derivative
HSN 2914 79 60 (Tembotrione) is subject to mandatory registration with the Central Insecticides Board and Registration Committee (CIB&RC) under Section 9 of the Insecticides Act and Rule 45 of the Insecticides Rules, 1971, as a herbicide intended for agricultural use. The Central Drugs Standard Control Organisation (CDSCO) registration applies where the substance falls within medical-device or drug scope under G.S.R. 102(E) dated 11-02-2020, and DGFT policy condition 7 of Chapter 29 governs the import policy framework effective 15 October 2025.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain mandatory registration or an import permit from the Central Insecticides Board and Registration Committee before shipment. Where Tembotrione is imported for a non-insecticidal purpose, a separate import permit from the Registration Committee under the Department of Agriculture and Cooperation is required; import must be sourced only from the facility specified on the certificate of registration or the permit.Section 9 of the Insecticides Act · Rule 45 of the Insecticides Rules, 1971 · CBIC Circular 35/2011 dated 09-08-2011 · CBIC Circular 7/2014 dated 07-03-2014
- 2Ensure mandatory additional qualifiers are included in the import declaration at the bill of entry stage for Chapter 29 commodities. Compliance with CBIC Circular 23/2023-Cus dated 30-09-2023, paragraphs 4.1 and 4.2, is required with effect from 15 October 2023.CBIC Circular 23/2023-Cus dated 30-09-2023 · DGFT Notification 44/2025-26 dated 15-10-2025 · ITC (HS) policy condition 7 of Chapter 29
- 3Verify that the consignment is not classified as a hazardous waste or ozone-depleting substance; if it is, compliance with ITC (HS) General Notes para 8(a) and 8(b), the Ozone Depleting Substances (Regulation and Control) Rules, 2000, and Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 apply. On import of specified hazardous substances exceeding specified quantities, take out an insurance policy per the Public Liability Insurance Act, 1991 and S.O. 227(E) dated 24-03-1992.S.O. 227(E) dated 24-03-1992 · Ozone Depleting Substances (Regulation and Control) Rules, 2000 · Hazardous Waste (Management and Transboundary Movement) Rules, 2016 · ITC (HS) General Notes para 8(a) and 8(b)
The most common error on this tariff line is conflating the CIB&RC registration for herbicidal use with a general-purpose import authorisation. Where the declared import purpose is non-insecticidal — for example, as an intermediate organic chemical — a separate import permit from the Registration Committee is still required, and diversion to insecticidal use without a registration certificate constitutes a violation of Section 9 of the Insecticides Act, attracting seizure of the consignment and prosecution under the Insecticides Rules, 1971.
