Compliance steps
  1. 1
Determine whether the specific substance being imported figures in the Schedule to the Insecticides Act, 1968. If so, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee, and route the consignment only through ports permitted under Rule 45 of the Insecticides Rules, 1971.

  2. 2
If the substance is an NDPS-scheduled compound, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for medical or scientific purposes per Chapter VII-A of those Rules; all other NDPS imports are governed by Appendix-I to the ITC (HS) Schedule.

  3. 3
Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by including all mandatory additional qualifiers in the import declaration for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2, with effect from 15 October 2023. Where import of a specified hazardous substance exceeds the specified quantity, take out an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.

A word of counsel

The most common error on this tariff line is filing a single bill of entry without first determining which of the three parallel regimes applies to the specific compound: CIB&RC (pesticide schedule), NDPS (scheduled narcotic or psychotropic), or DGFT general policy. A substance can fall within the Insecticides Act schedule and simultaneously carry a Chapter 29 CBIC qualifier obligation; filing without the CIB&RC permit at a non-notified port results in consignment detention at the port of import and exposes the importer to prosecution under Section 17 of the Insecticides Act, 1968.

Frequently asked
Does HSN 2914 40 00 require BIS certification?
No, no BIS Quality Control Order covers ketone-alcohols and ketone-aldehydes. Import is governed by the Central Insecticides Board and Registration Committee under the Insecticides Act, 1968 where applicable, with NDPS Rules, 1985 applying to any scheduled narcotic or psychotropic substance within this tariff line.
Are imports of all substances under this CTI restricted to specific ports?
Only those substances falling within the Schedule to the Insecticides Act, 1968 are subject to the port restriction under Rule 45 of the Insecticides Rules, 1971; the notified list of permitted import points should be verified with CIB&RC before shipment.
What is the consequence of importing a hazardous substance under this CTI in quantities exceeding the specified threshold without an insurance policy?
The importer is liable under the Public Liability Insurance Act, 1991 as notified by S.O. 227(E) dated 24-03-1992; absence of the required insurance policy constitutes a separate statutory contravention independent of customs clearance obligations.
