    Ensure mandatory additional qualifiers in the import declaration for Chapter 29 commodities as required under para 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, effective 15 October 2023. Where the substance is or contains an ozone-depleting substance, comply with policy conditions 1, 4 and 5 of Chapter 29 and para 8(a) of the ITC (HS) General Notes under the Ozone Depleting Substances (Regulation and Control) Rules, 2000.

    Where the substance qualifies as a narcotic drug or psychotropic substance under Chapter 29, comply with NDPS policy conditions 2 and 3 as applicable. Where hazardous waste is imported, comply with Rules 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and para 8(b) of the ITC (HS) General Notes; additionally, take out a public liability insurance policy under the PLI Act, 1991 for quantities exceeding the threshold prescribed under S.O. 227(E) dated 24-03-1992.

A word of counsel

The most common error on this tariff line is treating the DGFT free-import status under DGFT Notification 44/2025-26 dated 15-10-2025 as a complete clearance and overlooking the parallel end-use-triggered regimes. A consignment that is free under DGFT policy may still require a CDSCO registration (if a listed medical device), a CIB&RC permit (if for insecticidal use), or NDPS policy compliance (if a psychotropic substance) — and failure to upload the relevant PGA clearance in e-Sanchit before out-of-charge will result in consignment detention irrespective of the free-import tariff status.
