Acyclic ethers and their derivatives (diethyl ether, other acyclic ethers)
HSN 2909 19 90 (other acyclic ethers and their halogenated, sulphonated, nitrated or nitrosated derivatives) is covered by a Bureau of Indian Standards Quality Control Order. Conformity to IS 336:1973 is mandatory under the ISI Mark Scheme with effect from 25 December 2021, by virtue of the Ether (Quality Control) Amendment Order, 2021. Controls under the Narcotic Drugs and Psychotropic Substances regime, the Insecticides Act, 1968, and the Public Liability Insurance Act, 1991 apply as separate customs-clearance overlays.
Procedural directions for customs clearance are issued by: Central Board of Indirect Taxes and Customs, Directorate General of Foreign Trade.
- 1Source only from a Bureau of Indian Standards CM/L-licensed manufacturer holding a current licence against IS 336:1973 for ether. Verify the supplier's CM/L number, licensed product scope, and licensed manufacturing facility on the BIS online register before placing the purchase order.Ether (Quality Control) Amendment Order, 2021 · S.O. 2183(E) dated 29-06-2020 · S.O. 2548(E) dated 24-06-2021
- 2Ensure every consignment bears the ISI standard mark and the supplier's CM/L number under licence per Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018. Marking must appear on the product or its immediate container, not on outer packaging alone.Scheme-I of Schedule-II to the BIS (Conformity Assessment) Regulations, 2018 · S.O. 2183(E) dated 29-06-2020
- 3If the ether is a substance listed under the Narcotic Drugs and Psychotropic Substances Act, 1985, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 before shipment. Imports outside the medical and scientific purpose category are governed by Appendix-I to the ITC (HS) Schedule.Chapter VII-A of the NDPS Rules, 1985 · ITC (HS) policy condition 2 to Chapter 29
- 4If the product figures in the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee. Note that import locations are restricted under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971
- 5File mandatory additional qualifiers in the import declaration as required for Chapter 29 commodities with effect from 15 October 2023. If the consignment constitutes a specified hazardous substance exceeding the prescribed quantity, take out a public liability insurance policy before import.CBIC Circular 23/2023-CUS dated 30-09-2023 (para 4.1 and 4.2) · S.O. 227(E) dated 24-03-1992 (Public Liability Insurance Act, 1991)
The single most common error on this tariff line is treating IS 336:1973 as the only compliance gate and overlooking whether the specific ether variant is also a scheduled NDPS substance or a listed insecticide — each triggering an independent import authorisation that cannot be post-facto remedied at port. A consignment that is ISI-marked and CM/L-backed but arrives without the requisite NDPS import certificate or CIB&RC registration faces detention and potential confiscation under the governing statute, irrespective of BIS compliance status.
