Compliance steps
  1. 1
Where the substance falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the secretariat of CIB&RC before shipment. Import of scheduled insecticides is permitted only at the restricted places specified under Rule 45 of the Insecticides Rules, 1971; diversion to any other port or entry point renders the consignment liable to detention and confiscation.

  2. 2
Where the substance is a notified NDPS, import is permitted only for medical or scientific purposes under Chapter VII-A of the NDPS Rules, 1985 after obtaining an import certificate under Rule 53 of those Rules, or through Appendix-I to the ITC (HS) Schedule for other permitted categories. Upload mandatory documents — certificate of analysis (0010dc), batch release certificate (0030dc), label of consignment (0110dc), registration certificate for drugs (101dc1), and import licence for drugs (9111dc) — in e-Sanchit before the bill of entry is filed.

  3. 3
Ensure the import declaration includes the mandatory additional qualifiers for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus with effect from 15 October 2023. Where the quantity of any specified hazardous substance exceeds the threshold, the owner must obtain an insurance policy under the Public Liability Insurance Act, 1991 as notified by S.O. 227(E) dated 24-03-1992.

A word of counsel

The most frequent error on this tariff line is failing to determine, prior to filing the bill of entry, whether the specific derivative falls within the Schedule to the Insecticides Act, 1968 — a substance-by-substance determination, not a chapter-level default. An importer who uploads drug-regime documents (0010dc, 101dc1, 9111dc) without also confirming the CIB&RC Schedule position, or vice versa, will face detention at the port of import while the PGA routing is corrected; the port-restriction under Rule 45 of the Insecticides Rules, 1971 compounds the delay if the consignment has already arrived at an unauthorised entry point.
