HSN 2903 92 29 (Other halogenated hydrocarbon derivatives in the hexachlorobenzene/DDT subheading) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) controls apply concurrently: import is free subject to a No Objection Certificate from the Narcotics Commissioner, Gwalior, under ITC (HS) policy condition 3 to Chapter 29 and DGFT Notification 39/2015-2020 dated 03-10-2018. The most common error on this tariff line is importing under the assumption that a single PGA clearance suffices — the CIB&RC registration addresses the insecticide-schedule angle, but the NDPS NOC from the Narcotics Commissioner, Gwalior, is an entirely separate and concurrent prerequisite where the substance also falls under Appendix I of the ITC (HS) Schedule. Consignments presenting CIB&RC documentation without the NDPS NOC are detained at the port of import pending NDPS compliance, and retrospective NOC applications are not a recognised remedy under the NDPS Rules, 1985.
