Other halogenated hydrocarbon derivatives (pesticides, fluorochemicals)
HSN 2903 59 90 (Other halogenated derivatives of hydrocarbons) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) Rules, 1985 import-certificate conditions apply concurrently for any scheduled narcotic or psychotropic substance, and the Directorate General of Foreign Trade (DGFT) Chemical Weapons Convention (CWC) policy condition 3 of Chapter 29 governs import of Category 1B chemical PFIB from CWC State Parties only.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Determine whether the specific substance falls within the Schedule to the Insecticides Act, 1968. If so, obtain registration and an import permit from the Secretariat of CIB&RC before shipment, and note that import is restricted to places specified under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) CCR for CTI 2903 59 90
- 2If the substance is a scheduled NDPS, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 before filing the bill of entry. For non-medical/non-scientific NDPS imports, compliance with Appendix I of the ITC (HS) Schedule and ITC (HS) policy condition 2 of Chapter 29 is mandatory.Chapter VII-A of the NDPS Rules, 1985 · Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2, Chapter 29
- 3Ensure mandatory additional qualifiers are included in the import declaration per CBIC Circular 23/2023-Cus dated 30-09-2023, effective 15 October 2023. For Category 1B chemical PFIB, notify details of each consignment to the National Authority CWC, Cabinet Secretariat, Ministry of External Affairs (D&ISA), Department of Chemicals and Petrochemicals, and DGFT within 30 days of import, and submit a copy of the bill of entry to DGFT within the same window.CBIC Circular 23/2023-Cus dated 30-09-2023, para 4.1 and 4.2 · CWC Act and Rules · ITC (HS) policy condition 3, Chapter 29
The most common error on this residual tariff line is assuming that, because the 8-digit description reads 'Other', no specific regulatory trigger applies. In practice, substances classifiable here may simultaneously engage three distinct regimes — CIB&RC Schedule-to-the-Act scrutiny, NDPS import-certificate obligations, and CWC post-import notification — and failure to identify the correct sub-regime before shipment results in consignment detention and, for NDPS and CWC substances, potential criminal liability. Additionally, the Public Liability Insurance Act, 1991 insurance obligation under S.O. 227(E) dated 24-03-1992 attaches at the moment of import of specified hazardous substances exceeding notified threshold quantities, independently of the PGA clearances.
