1,1,3,3,3-pentafluoro-2-(trifluoromethyl)prop-1-ene [Perfluoroisobutene (PFIB)]
Perfluoroisobutene (PFIB), halogenated fluorocarbon derivative
HSN 2903 59 10 (Perfluoroisobutene / PFIB) is a Category 1B chemical under the Chemical Weapons Convention (CWC) Act and Rules, administered by the Directorate General of Foreign Trade (DGFT) under ITC (HS) policy condition 3 of Chapter 29, permitting import exclusively from State Parties to the CWC with mandatory post-import notification to the National Authority within 30 days. Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968 apply where PFIB appears in the Schedule to that Act, and Narcotic Drugs and Psychotropic Substances (NDPS) Rules conditions govern any NDPS-classified consignment under Chapter VII-A of the NDPS Rules, 1985.
- Registration and import permit from CIB&RC
- CWC notification declaration to DGFT
- Chapter 29 mandatory qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Verify the country of export is a State Party to the Chemical Weapons Convention before placing the purchase order. For each consignment, submit post-import notification within 30 days to the National Authority CWC (Cabinet Secretariat), Ministry of External Affairs (D&ISA), Department of Chemicals and Petrochemicals, and DGFT, and file a copy of the bill of entry with DGFT within that 30-day window.CWC Act and Rules · ITC (HS) import policy condition 3 of Chapter 29 · Appendix II of ITC (HS) Import Policy
- 2Where PFIB appears in the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before the consignment is shipped. Import must be routed through ports notified under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971
- 3Ensure the bill of entry carries all mandatory additional qualifiers for Chapter 29 commodities as stipulated in Paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, applicable with effect from 15-10-2023. If the consignment exceeds notified quantities of specified hazardous substances, take out a public liability insurance policy under S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The single most frequent compliance failure on this tariff line is treating the CWC origin restriction and the DGFT notification as simultaneous obligations when they are in fact sequential: the State-Party verification must precede shipment, while the 30-day notification to five separate authorities is a post-import obligation — missing either limb independently constitutes a separate breach. Where PFIB also falls within the Insecticides Act Schedule, importers sometimes assume the CWC clearance satisfies all regulatory requirements; the CIB&RC permit and restricted-port conditions under the Insecticides Rules, 1971 operate as an entirely independent regime and must be obtained concurrently.
