Compliance steps
  1. 1
Obtain an Import Authorisation from the Directorate General of Foreign Trade backed by a recommendation from the Ozone Cell, MoEF&CC, before the consignment is shipped. The Restricted-import classification under policy condition no. 05 of Chapter 29, ITC (HS) 2022 Schedule I means a bill of entry filed without a valid Import Authorisation will be detained.

  2. 2
Ensure the import declaration includes all mandatory additional qualifiers for Chapter 29 commodities as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, applicable with effect from 15 October 2023. Missing or incomplete qualifiers render the declaration non-compliant and will delay out-of-charge.

A word of counsel

The most common error on this tariff line is initiating the shipment on the strength of a pending Ozone Cell recommendation rather than a formally issued Import Authorisation from DGFT. The Ozone Cell recommendation is a prerequisite to the DGFT authorisation — it is not itself the import licence — and a consignment arriving before the Import Authorisation is issued is subject to detention and, if the authorisation is ultimately refused, to re-export or confiscation under the Foreign Trade (Development and Regulation) Act, 1992.

Frequently asked
Does HSN 2903 48 00 require BIS certification?
No, no BIS Quality Control Order covers hydrofluorocarbons under this tariff line. Import is governed by the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade, requiring an Import Authorisation supported by an Ozone Cell, MoEF&CC recommendation under policy condition no. 05 of Chapter 29.
What are the mandatory Chapter 29 qualifiers required under CBIC Circular 23/2023-Cus?
Paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30 September 2023 prescribe additional qualifiers that must be declared in the import declaration for all commodities under Chapter 29, effective 15 October 2023; the exact qualifier fields are set out in the Circular's annexures.
Does the Ozone Cell recommendation itself authorise import of HFCs?
No. The Ozone Cell, MoEF&CC recommendation is a prerequisite that DGFT requires before issuing an Import Authorisation; the Import Authorisation from DGFT is the operative instrument that permits the Restricted-import entry.
