HSN 2903 47 00 (HFC-245fa and HFC-245ca) is subject to the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT), under which import of hydrofluorocarbons is permitted only with an import authorisation issued subject to the recommendation of the Ozone Cell, Ministry of Environment, Forest and Climate Change (MoEF&CC). The Central Board of Indirect Taxes and Customs (CBIC) additionally requires mandatory additional qualifiers in the import declaration for all Chapter 29 commodities, effective 15 October 2023.

    Declare all mandatory additional qualifiers in the import declaration as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023. This requirement applies to all commodities under Chapters 28, 29, 32, 39 and CTH 3808, and has been operative with effect from 15 October 2023.

The most common error on this tariff line is initiating procurement — and in some cases vessel booking — before the Ozone Cell recommendation is in hand. The import authorisation from DGFT cannot be issued without that recommendation, making the Ozone Cell the de facto gate that controls timing; importers who treat the two steps as concurrent rather than sequential routinely face consignment detention and demurrage while the recommendation is processed post-shipment.
