Vinyl chloride (chloroethylene)
Vinyl chloride, chloroethylene halogenated hydrocarbon
HSN 2903 21 00 (Vinyl chloride) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) import-certificate controls under Chapter VII-A of the NDPS Rules, 1985 and ITC (HS) policy condition 2 of Chapter 29 administered by the Directorate General of Foreign Trade (DGFT) apply as concurrent overlays. Mandatory additional qualifiers in the import declaration are required under CBIC Circular 23/2023-Cus dated 30-09-2023 for all Chapter 29 commodities.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where vinyl chloride figures in the Schedule to the Insecticides Act, 1968, obtain a valid registration certificate and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Note that the places at which insecticides may be imported are restricted under Rule 45 of the Insecticides Rules, 1971; route the consignment accordingly.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2If the substance is being imported for medical or scientific purposes under the NDPS framework, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 (Chapter VII-A). Imports outside that special provision are governed by Appendix-I to the ITC (HS) Schedule and must comply with the conditions therein.Rule 53 of the NDPS Rules, 1985 · Chapter VII-A · ITC (HS) policy condition 2 of Chapter 29
- 3File the bill of entry with mandatory additional qualifiers as prescribed under paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus dated 30-09-2023, effective 15 October 2023, for all Chapter 29 commodities. Where the imported quantity exceeds the specified threshold for hazardous substances, obtain an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is assuming that a valid CIB&RC registration alone satisfies customs out-of-charge. Vinyl chloride may simultaneously engage the NDPS import-certificate regime and the restricted-port list under Rule 45 of the Insecticides Rules, 1971 — both must be resolved before the bill of entry is filed. Failure to submit the Chapter 29 mandatory qualifiers under CBIC Circular 23/2023-Cus is treated as a misdeclaration, exposing the consignment to detention and monetary penalty under the Customs Act, 1962.
