Other halogenated hydrocarbon derivatives (residual category)
HSN 2903 19 90 (Other halogenated derivatives of hydrocarbons) is subject to registration and import permit requirements of the Central Insecticides Board and Registration Committee (CIB&RC) under the Insecticides Act, 1968, where the substance falls within the Schedule to that Act. Narcotic Drugs and Psychotropic Substances (NDPS) controls under Chapter VII-A of the NDPS Rules, 1985 apply concurrently where the substance is a scheduled NDPS, and Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 governs all other imports under this tariff line.
- Registration certificate from CIB&RC
- Import permit from CIB&RC
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Determine whether the specific substance falls within the Schedule to the Insecticides Act, 1968. If it does, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before filing the bill of entry; import is additionally restricted to ports notified under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971 · ITC (HS) policy condition 2 of Chapter 29
- 2If the substance is a scheduled Narcotic Drug or Psychotropic Substance, import is permissible only for medical or scientific purposes under Chapter VII-A of the NDPS Rules, 1985, and requires an import certificate under Rule 53 of those Rules; all other NDPS imports are governed by Appendix-I to the ITC (HS) Schedule.Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2 of Chapter 29
- 3Ensure mandatory Chapter 29 additional qualifiers are included in the import declaration at the bill of entry in compliance with CBIC Circular 23/2023-Cus dated 30-09-2023, as stipulated in paragraphs 4.1 and 4.2, with effect from 15 October 2023. Where import quantities of specified hazardous substances exceed the notified threshold, obtain an insurance policy under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The critical error on this residual tariff line is assuming the CIB&RC and NDPS regimes are mutually exclusive — a substance may simultaneously be scheduled under the Insecticides Act, 1968 and fall within the NDPS ambit, triggering dual permit requirements. The port-of-import restriction under Rule 45 of the Insecticides Rules, 1971 operates independently of the permit: a consignment routed through a non-notified port faces seizure even where the CIB&RC registration and permit are current and valid.
