CIB&RC CLEARANCE · NDPS CLEARANCE

HSN 2902 42 00 (m-Xylene) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968, where the substance figures in the Schedule to that Act. The Narcotic Drugs and Psychotropic Substances (NDPS) regime under Chapter VII-A of the NDPS Rules, 1985 applies as a concurrent overlay for scheduled substances, and the Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 governs non-medical imports of NDPS-listed substances.

Compliance steps
  1. 1
If m-Xylene falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee before shipment. Import is restricted to the ports specified under Rule 45 of the Insecticides Rules, 1971; consignments routed through unlisted ports are liable to detention and confiscation.
Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971
  2. 2
Where the substance is scheduled under the NDPS regime, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 for medical or scientific purposes, or ensure compliance with Appendix I of the ITC (HS) Schedule for non-medical imports. Refer to the Central Bureau of Narcotics (http://cbn.nic.in) for the current procedure.

  3. 3
Comply with CBIC Circular 23/2023-Cus dated 30-09-2023 by declaring mandatory additional qualifiers in the import declaration for commodities under Chapter 29, as stipulated in paragraphs 4.1 and 4.2, with effect from 15 October 2023. Additionally, where import exceeds the specified quantity of a hazardous substance, take out a public liability insurance policy under S.O. 227(E) dated 24-03-1992.

A word of counsel

The most common error on this tariff line is treating CIB&RC registration and NDPS compliance as mutually exclusive tracks — importers often check only one regime and miss the other. m-Xylene may simultaneously be schedulable under the Insecticides Act, 1968 and attract NDPS scrutiny depending on end-use and formulation context; a consignment cleared under the CIB&RC permit without the NDPS import certificate, where that certificate is required, faces seizure under the NDPS Act, 1985 independently of any Insecticides Act compliance.

Frequently asked
Does HSN 2902 42 00 require BIS certification?
No, m-Xylene is not within the BIS Quality Control Order regime; no BIS QCO covers this cyclic hydrocarbon. Import is governed by CIB&RC registration and permit under the Insecticides Act, 1968 where the substance is scheduled, with an NDPS overlay under the NDPS Rules, 1985 and DGFT ITC (HS) policy condition 2 of Chapter 29.
Are all ports open for import of m-Xylene falling under the Insecticides Act, 1968?
No. Rule 45 of the Insecticides Rules, 1971 restricts import of scheduled insecticides to specified ports only; consignments must be routed accordingly before booking the vessel.
When does the public liability insurance requirement apply to this import?
The insurance obligation under S.O. 227(E) dated 24-03-1992 is triggered when the imported quantity of the specified hazardous substance exceeds the threshold quantities prescribed by the Ministry of Environment and Forests under the Public Liability Insurance Act, 1991.
