A word of counsel

The most common error on this tariff line is failing to determine at the pre-shipment stage whether the acetylene consignment triggers the CIB&RC schedule — an oversight discovered only at the port of entry, where the consignment is detained until registration and permit documentation are produced. The CIB&RC port restriction under Rule 45 of the Insecticides Rules, 1971 is independent of the NDPS and Chapter 29 qualifier obligations; a consignment compliant with NDPS and CBIC requirements but arriving at a non-notified port remains liable to seizure under the Insecticides Act, 1968.

Frequently asked
Does HSN 2901 29 10 require BIS certification?
No, acetylene in dissolved or undissolved condition is not covered by any BIS Quality Control Order. Import is governed by the NDPS Rules, 1985 for medical and scientific purposes, with CIB&RC registration and permit requirements where the substance falls within the Schedule to the Insecticides Act, 1968, and DGFT ITC (HS) policy condition 2 of Chapter 29.
Are there port restrictions on importing acetylene under this tariff line?
Yes. Where the product falls within the Schedule to the Insecticides Act, 1968, import is restricted to notified locations under Rule 45 of the Insecticides Rules, 1971; routing through any other port renders the consignment liable to seizure regardless of NDPS or CBIC compliance.
Does the public liability insurance requirement apply to every consignment of acetylene?
No. The requirement under the Public Liability Insurance Act, 1991 per S.O. 227(E) dated 24-03-1992 applies only where the import of specified hazardous substances exceeds the prescribed quantities; consignments below those thresholds are not subject to the mandatory insurance obligation.
