Ethylene
Ethylene, acyclic hydrocarbon gas
HSN 2901 21 00 (Ethylene) is subject to Central Insecticides Board and Registration Committee (CIB&RC) registration and import permit under the Insecticides Act, 1968 and Insecticides Rules, 1971, where ethylene falls within the scheduled insecticide list. Narcotic Drugs and Psychotropic Substances (NDPS) controls under Chapter VII-A of the NDPS Rules, 1985 apply as a concurrent overlay, and the Directorate General of Foreign Trade (DGFT) ITC (HS) policy condition 2 of Chapter 29 governs non-medical imports.
- Registration and permit from CIB&RC
- Import certificate from NDPS
- Chapter 29 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Where the ethylene consignment falls within the Schedule to the Insecticides Act, 1968, obtain registration and an import permit from the Secretariat of the Central Insecticides Board and Registration Committee. Route the consignment only through ports at which insecticides may be imported under Rule 45 of the Insecticides Rules, 1971.Insecticides Act, 1968 · Rule 45 of the Insecticides Rules, 1971
- 2Where the consignment is imported for medical or scientific purposes under the NDPS overlay, obtain an import certificate under Rule 53 of the NDPS Rules, 1985 as per Chapter VII-A. Imports outside that category are governed by Appendix-I to the ITC (HS) Schedule under ITC (HS) policy condition 2 of Chapter 29.Rule 53 of the NDPS Rules, 1985 · ITC (HS) policy condition 2, Chapter 29
- 3File mandatory additional qualifiers in the import declaration for Chapter 29 commodities at the bill of entry, in compliance with CBIC Circular 23/2023-Cus dated 30-09-2023, paragraphs 4.1 and 4.2, with effect from 15 October 2023. Additionally, where the import involves specified hazardous substances exceeding specified quantities, obtain a public liability insurance policy under S.O. 227(E) dated 24-03-1992.CBIC Circular 23/2023-Cus dated 30-09-2023 · S.O. 227(E) dated 24-03-1992
The most common error on this tariff line is assuming that ethylene, as a bulk petrochemical feedstock, falls entirely outside the Insecticides Act, 1968 schedule and filing without CIB&RC registration. Whether a given consignment is scheduled depends on its declared end-use and formulation context; customs officers at restricted insecticide ports are empowered to detain consignments where CIB&RC registration and permit are absent, and the port-restriction under Rule 45 of the Insecticides Rules, 1971 operates independently of the NDPS and DGFT overlays.
