Tritium and its compounds; alloys, dispersions (including cermets), ceramic products and mixtures containing tritium or its compounds
Tritium and its compounds, alloys, mixtures containing tritium
HSN 2844 41 00 (Tritium and its compounds; alloys, dispersions, ceramic products and mixtures containing tritium) is subject to Atomic Energy Regulatory Board (AERB) licensing under the Atomic Energy Act, 1962 and the rules thereunder. The tariff line is Restricted under the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), with a limited Free-import carve-out for radioimmunoassay kits for disease diagnosis in humans or animals, subject to prior AERB permission. Mandatory Chapter 28 chemical qualifiers under CBIC Circular 23/2023-Cus dated 30-09-2023 apply at the bill-of-entry stage.
- Import licence from AERB
- Prior permission from AERB
- Chapter 28 qualifiers from CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain a valid import licence from the Atomic Energy Regulatory Board under the Atomic Energy Act, 1962 before shipment. For radioimmunoassay kits intended for diagnosis of disease or disorders in humans or animals, obtain prior AERB permission — the Free-import status for this sub-category is conditional on that permission being secured in advance.Atomic Energy Act, 1962 · DGFT Notification 54/2015-20 dated 09-02-2022
- 2At the bill of entry, include mandatory additional qualifiers for commodities under Chapter 28 as stipulated in paragraphs 4.1 and 4.2 of CBIC Circular 23/2023-Cus. These qualifiers are required in the import declaration with effect from 15 October 2023 and must be uploaded in e-Sanchit before out-of-charge.CBIC Circular 23/2023-Cus dated 30-09-2023, paragraphs 4.1 and 4.2
The most common error on this tariff line is treating the radioimmunoassay-kit carve-out as a general exemption from AERB control. The Free-import status for diagnostic RIA kits is not self-executing: prior AERB permission remains a hard condition, and a consignment arriving without that permission is treated as a Restricted-import in violation of the ITC (HS) policy, exposing the importer to detention, confiscation, and monetary penalty under the Atomic Energy Act, 1962.
