Compliance steps
  1. 1
Ensure the FSSAI Import Licence (document code 911001) is current and uploaded in e-Sanchit before filing the bill of entry. The Specimen Copy of Label (document code 0110FS) must also be uploaded; labelling deficiencies permissible for port rectification are limited to those specified under FSS (Labelling and Display) Regulations, 2020 per CBIC Instruction 10/2022-Cus and FSSAI order dated 18-11-2022.
    CBIC Instruction 10/2022-Cus dated 28-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023 · FSSAI order dated 18-11-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022
  2. 2
Upload all mandatory documents in e-Sanchit before out-of-charge: Certificate of Analysis — Drug (document code 0010dc), Batch Release Certificate (document code 0030dc), Label of Consignment (document code 0110dc), and Registration Certificate — Drugs (document code 101dc1). PGA-facilitated bills not routed through the PGA for NOC are subject to officer verification of each uploaded document.

  3. 3
Include mandatory additional qualifiers in the import declaration for Chapter 28 commodities as required by CBIC Circular 23/2023-Cus, with effect from 15 October 2023. Non-inclusion of the qualifiers specified in paragraphs 4.1 and 4.2 of that circular renders the entry deficient and liable to detention.

A word of counsel

Sodium nitrite straddles both the food-additive and industrial-chemical categories, and the most common error is assuming that a drug or industrial consignment is exempt from FSSAI Import Licence requirements simply because the declared end-use is non-food. Customs officers apply the FSSAI overlay to the tariff line regardless of declared end-use; an importer without a current FSSAI Import Licence faces consignment detention at the designated food-import port and cannot rectify a missing PGA clearance through the labelling-rectification dispensation, which applies only to label deficiencies, not absent licences.
