Compliance steps

A Non-GM origin cum GM-free attestation on the phytosanitary or health certificate is also accepted, provided it contains all information and declarations specified in the FSSAI order dated 21-08-2021.
FSSAI order F.N. 1-1764/FSSAI/Imports/2018(part1) dated 03-12-2020 and FSSAI order dated 21-08-2021

  3. 3
Route the consignment only through a designated food-import entry point compliant with General Note 4(D) of Schedule I of the ITC (HS) 2022. Any labelling deficiencies permissible under the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020 must be rectified at the customs bonded warehouse before visual inspection, by affixing a single non-detachable sticker without altering the original label.
    General Note 4(D) of Schedule I of the ITC (HS) 2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
A word of counsel

The most common error on this tariff line is dispatching the consignment without the Non-GM origin cum GM-free attestation — or obtaining an attestation that omits the specific declarations mandated by the FSSAI order dated 21-08-2021. A phytosanitary certificate that carries only a generic GM-free statement, without the full format prescribed by FSSAI, is rejected at the port and the consignment is detained pending a conforming certificate; re-export or destruction may follow if the defect cannot be remedied within the permitted rectification window.
