Peas (pisum, sativum)
Prepared or preserved peas, not frozen (Pisum sativum)
HSN 2005 40 00 (Peas, Pisum sativum) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence requirements under the Food Safety and Standards Act, 2006, including foreign-label compliance under the FSS (Labelling and Display) Regulations, 2020. Import entry is restricted to designated food-import ports under General Note 4(D) of Schedule I of the ITC (HS) 2022, administered by the Directorate General of Foreign Trade (DGFT) and enforced by the Central Board of Indirect Taxes and Customs (CBIC).
- Import Licence from FSSAI
- Specimen copy of label from FSSAI
- Designated-port declaration to CBIC
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence and ensure the Specimen Copy of Label is prepared in compliance with the FSS (Labelling and Display) Regulations, 2020. Both documents — FSSAI Import Licence (document code 911001) and Specimen Copy of Label (document code 0110FS) — must be uploaded in e-Sanchit before the bill of entry is filed.FSSAI Import Licence document code 911001 · Specimen Copy of Label document code 0110FS · CBIC Instruction 10/2022-Customs dated 28-06-2022
- 2Route the consignment only through one of the designated food-import entry points notified under General Note 4(D) of Schedule I of the ITC (HS) 2022. Arrival at a non-designated port will result in consignment detention pending re-routing or re-export.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Where labelling deficiencies exist on arrival — including missing per-serve percentage contribution to recommended dietary allowance, or expiry date alongside best-before date — rectification may be permitted at the customs bonded warehouse by affixing a single non-detachable sticker next to the principal display panel, subject to authorised officer verification. Rectification must not alter original label information.CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI order F.No.Import/TFM/Apex/2022-FSSAI dated 18-11-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022
The most common error on this tariff line is assuming that the port-of-import restriction is an administrative preference rather than a binding condition. Consignments of prepared peas arriving at a non-designated food-import port cannot be cleared by FSSAI and are subject to detention, accumulating demurrage and ground rent, with re-export as the likely outcome if re-routing is not feasible. Confirm the designated-port list against the bill of lading before vessel departure; the FSSAI licence alone does not cure a port-of-entry violation.
