Barley seed for sowing
HSN 1003 10 00 (Barley seed) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence under the Food Safety and Standards Act, 2006, and the tariff line is Restricted under ITC (HS) import policy condition 2 of Chapter 10, administered by the Directorate General of Foreign Trade (DGFT). Consignments must be routed through designated food-import entry points under General Note 4(D) of Schedule I of the ITC (HS) 2022, with Phyto-Sanitary Certificate and specimen label upload mandated in e-Sanchit before out-of-charge.
- Import Licence from FSSAI
- Phyto-Sanitary Certificate from exporting country
- Specimen copy of label from FSSAI
Procedural directions for customs clearance are issued by: Directorate General of Foreign Trade, Central Board of Indirect Taxes and Customs.
- 1Obtain the FSSAI Import Licence (document code 911001) and upload it in e-Sanchit before filing the bill of entry. The consignment is Restricted under ITC (HS) policy condition 2 of Chapter 10; importers must confirm the licence is current and that the foreign facility and product category are within its scope.ITC (HS) import policy condition 2 of Chapter 10 · FSSAI Import Licence document code 911001
- 2Upload the Phyto-Sanitary Certificate (document code 851000) and the Specimen Copy of Label (document code 0110FS) in e-Sanchit before customs out-of-charge. Labelling deficiencies identified at the port may be rectified by affixing a single non-detachable sticker next to the principal display panel per the FSS (Labelling and Display) Regulations, 2020, without altering the original label.CBIC Instruction 10/2022-Customs dated 28-06-2022 · FSSAI Letter 1828/Misc Matters/FSSAI/Imports-2021 dated 17-06-2022 · CBIC Instruction 09/2023-Cus dated 07-03-2023
- 3Route the consignment only through the designated food-import entry points listed under General Note 4(D) of Schedule I of the ITC (HS) 2022. Consignments arriving at non-designated ports are liable to detention pending diversion or re-export.General Note 4(D) of Schedule I of the ITC (HS) 2022 · CBIC Instruction 05/2023-Cus dated 08-02-2023
The most common error on this tariff line is treating the FSSAI Import Licence as the sole clearance document and overlooking the Phyto-Sanitary Certificate, which is an independent plant-quarantine requirement uploaded separately under document code 851000. A bill of entry presented with a current FSSAI licence but a missing or expired Phyto-Sanitary Certificate will be held at the designated port — attracting demurrage and ground rent — until the certificate is produced; the rectifiable-labelling dispensation under FSS (Import) Regulations, 2017 does not cure an absent PGA document.
