HSN 0901 12 00 (Decaffeinated coffee, not roasted) is subject to Food Safety and Standards Authority of India (FSSAI) Import Licence and labelling compliance under the Food Safety and Standards Act, 2006, including the FSS (Import) Regulations, 2017 and FSS (Labelling and Display) Regulations, 2020. The tariff line is also governed by ITC (HS) policy condition 1 of Chapter 9 administered by the Directorate General of Foreign Trade (DGFT), with General Note 4(D) of Schedule I of the ITC (HS) 2022 restricting import to designated food-import entry points.

The most overlooked trap on this tariff line is the Coffee Board permit requirement for re-imported coffee: importers who originally exported Indian-origin coffee and seek to re-import it under HSN 0901 12 00 must obtain a Coffee Board permit under Section 21 of the Coffee Act, 1942 — a requirement entirely separate from the FSSAI Import Licence regime. Treating the FSSAI clearance as the sole gate and bypassing the Coffee Board permit exposes the consignment to detention and potential confiscation under the Coffee Act, regardless of FSSAI compliance status.
