- 1Obtain the requisite PESO import licence under the Explosives Act, 1884 and the Explosives Rules, 2008 before filing the bill of entry. The licence must cover the specific category and quantity of cartridges and must be uploaded in e-Sanchit prior to out-of-charge.Explosives Act, 1884 · Explosives Rules, 2008 · ITC (HS) Policy Conditions 1, 2, 3 and 4 to Chapter 93
- 2Confirm the country of origin is not Iraq before placing the purchase order. Import of arms and related material from Iraq is absolutely prohibited under ITC (HS) Policy Condition 5 to Chapter 93, and a consignment arriving from Iraq is liable to confiscation and criminal liability under the Customs Act, 1962.ITC (HS) Policy Condition 5 to Chapter 93
The most frequent error on this tariff line is conflating the ITC (HS) Restricted-import policy conditions with a general permission to import: each of Policy Conditions 1, 2, 3 and 4 to Chapter 93 carries distinct eligibility and end-use criteria, and satisfying one condition does not satisfy the others. Importers who obtain a PESO licence but fail to verify which specific Policy Condition authorises their particular category of cartridges find the consignment detained at the port of import pending DGFT regularisation.
