Aeroplanes and other aircraft not exceeding 2,000 kg unladen weight
HSN 8802 20 00 (Aeroplanes and other aircraft not exceeding 2,000 kg unladen weight) is subject to Directorate General of Foreign Trade (DGFT) import policy controls under Policy Condition 1 to Chapter 88, with import generally Restricted except for enumerated categories of eligible importers. Entities outside the enumerated categories — including scheduled and non-scheduled air transport operators and aerial-work operators — must obtain a No Objection Certificate from the Directorate General of Civil Aviation (DGCA) before import is permitted.
- NOC for import of aircraft from DGCA
- Import Licence from DGFT
- ITC (HS) eligibility declaration to CBIC
- 1Confirm that the importing entity falls within one of the licence-exempt categories under Policy Condition 1 to Chapter 88: Air India, Pawan Hans Limited, Airports Authority of India, IGRUA or a Ministry of Civil Aviation-recognised flying club or academy, or an IFSC-based aircraft leasing entity. If the entity does not qualify under any of these categories, a DGFT import licence is required before the bill of entry is filed.Policy Condition 1 to Chapter 88 · DGFT Notification 21/2015-20 dated 31-08-2021
- 2Any person or entity not within the licence-exempt categories but holding a DGCA NOC for scheduled, scheduled-commuter, non-scheduled air transport services, or aerial-work operations may import without a separate DGFT import licence. Upload the DGCA No Objection Certificate (document code 911DA3) in e-Sanchit before the bill of entry reaches out-of-charge.Policy Condition 1 to Chapter 88 · DGFT Notification 21/2015-20 dated 31-08-2021
The most common error on this tariff line is conflating DGCA operational approvals — such as an Air Operator Permit or fleet-addition approval — with the DGCA NOC specifically required for import or procurement of aircraft. An Air Operator Permit does not substitute for the import NOC (document code 911DA3); customs officers are instructed to verify the NOC upload in e-Sanchit on PGA-facilitated bills, and a missing or incorrect document triggers detention and demurrage pending regularisation.
