DGFT CLEARANCE

HSN 8112 49 00 (Other base metal waste and scrap) is subject to the Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT) under the ITC (HS) Import Policy, with import permitted only at specified ports and locations under Para 2.54 of the Handbook of Procedures. A Pre-Shipment Inspection Certificate (PSIC) generated mandatorily through the DGFT online system is required for both shredded and non-shredded scrap, and waste consignments are additionally subject to the Hazardous Waste (Management and Transboundary Movement) Rules, 2016.

    Obtain a Pre-Shipment Inspection Certificate from a recognised Pre-Shipment Inspection Agency using the mandatory DGFT online system. PSICs dated on or after 1 July 2022 not generated through the DGFT online portal will not be accepted by Indian Customs; upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

    Route the consignment only through the specified ports and locations notified for metal scrap clearance. If the export originates from a safe country or region and arrives through a specified port, the PSIC requirement is waived; verify the current safe-country list and follow the radioactive-contamination random-check SOP per the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021.

    Where the consignment constitutes waste, comply with Para 8(B) of the General Notes on Import Policy of the ITC (HS), and ensure Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 are satisfied. Submit valid Forms 2, 6, 7 and 9 and the documents prescribed in Schedules III, VI and VIII of those Rules alongside the bill of entry.

A word of counsel

The most common error on this tariff line is submitting a PSIC generated outside the DGFT online portal — particularly legacy certificates issued before 1 July 2022 or certificates generated by a PSIA through a non-DGFT system. Indian Customs authorities are instructed not to accept such certificates, and a non-conforming PSIC results in consignment detention at the specified port pending regularisation. For un-shredded scrap (HMS-I and HMS-II), the additional procedural requirements under DGFT Public Notice 38/2015-20 and corrigendum Public Notice 40/2015-20 apply separately from the general PSIC regime.
