DGFT CLEARANCE

HSN 8112 41 20 (Waste and scrap of vanadium, indium, gallium or niobium) is subject to a Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT) under the ITC (HS) Import Policy, requiring a Pre-Shipment Inspection Certificate (PSIC) generated through the DGFT online portal. PSICs dated on or after 1 July 2022 that are not generated via DGFT online systems will not be accepted by Indian Customs; upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

    Route the consignment through one of the specified ports/locations notified under Para 2.54 of the Handbook of Procedures. Imports from safe countries or regions are exempt from the PSIC requirement only when arriving through those specified ports; all other origins require a PSIC regardless of port. Comply with the radioactive contamination SOP per the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021.

    Ensure compliance with Para 8(B) of the General Notes of the ITC (HS) Import Policy and Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016; submit valid Forms 2, 6, 7 and 9 as required under those Rules along with references to Schedules III, VI and VIII for applicable descriptions, conditions and notes.

A word of counsel

The most common error on this tariff line is assuming the safe-country PSIC exemption applies unconditionally. The exemption from PSIC operates only when the consignment is imported through one of the specified ports notified under Para 2.54; an origin from a safe country routed through a non-specified port triggers the full PSIC requirement and risks detention and ground rent. Separately, the Hazardous Waste Rules obligations — Forms 2, 6, 7 and 9 — are independent of the PSIC and must be satisfied even when the PSIC is waived.
