DGFT CLEARANCE

HSN 8112 31 30 (Powders of beryllium, chromium, hafnium, rhenium, thallium, cadmium, germanium, vanadium, gallium, indium and niobium group metals) is subject to the Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT) under the ITC (HS) Import Policy, Chapter 81.     Obtain a Pre-Shipment Inspection Certificate (PSIC) generated online through the DGFT portal before shipment. All PSICs dated on or after 1 July 2022 must be generated through the DGFT online system; certificates not generated via the DGFT platform will not be accepted by Indian Customs. Upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

    Ensure the consignment is routed through a specified port or location notified under Para 2.54 of the Handbook of Procedures. For imports from safe countries or regions through specified ports, the PSIC requirement may be waived; verify applicability against DGFT Public Notice 64/2015-20 and Public Notice 46/2015-20 before vessel departure.

    Where the goods constitute waste or scrap, comply with Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and submit valid Forms 2, 6, 7 and 9 along with documents listed in Schedules III, VI and VIII. The consignment is also subject to random radioactive-contamination checking per the SOP in the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021.

A word of counsel

The most common error on this tariff line is conflating the PSIC safe-country waiver with a general exemption from the Restricted-import condition: even where PSIC is waived for safe-country origins at specified ports, the consignment remains Restricted and must satisfy Para 2.54 port and documentation conditions. Where the goods are scrap or waste, the Hazardous Waste Rules overlay applies independently of the PSIC regime, and missing any of Forms 2, 6, 7 or 9 at the bill-of-entry stage results in consignment detention regardless of PSIC status.
