DGFT CLEARANCE

HSN 8106 90 90 (Other bismuth articles, waste and scrap) is subject to the ITC (HS) Restricted-import policy administered by the Directorate General of Foreign Trade (DGFT), requiring a Pre-Shipment Inspection Certificate for metal scrap consignments.     Obtain a Pre-Shipment Inspection Certificate (PSIC) for the metal scrap consignment from a recognised Pre-Shipment Inspection Agency (PSIA). All PSICs dated on or after 1 July 2022 must be generated online through the DGFT website; PSICs not generated through the DGFT online system will not be accepted by Indian Customs. Upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

    Route the consignment exclusively through specified ports or locations notified under Para 2.54 of the Handbook of Procedures. If the export originates from a safe country or region and enters through a specified port, the PSIC may not be required — confirm eligibility against the safe-country list before dispatch. Comply with Para 2.32 of the Foreign Trade Policy and Paras 2.54 and 2.55 of the FTP Procedure.

    Where the consignment constitutes waste, comply with Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and submit valid Forms 2, 6, 7 and 9 along with Schedule-III, VI and VIII documentation. Consignments must also pass the radioactive-contamination random-check protocol set out in the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021.

A word of counsel

The most common error on this tariff line is assuming that a PSIC generated outside the DGFT online portal remains valid post-1 July 2022. A manually issued PSIC — even one bearing a date and an accredited PSIA stamp — will be rejected by Indian Customs at the bill-of-entry stage, resulting in consignment detention and accumulating demurrage until a compliant PSIC is uploaded in e-Sanchit under document code 856001. Importers of un-shredded scrap (HMS-I and HMS-II) face additional procedural requirements under DGFT Public Notice 38/2015-20 and its corrigendum 40/2015-20 that are separate from the PSIC obligation.

Does HSN 8106 90 90 require BIS certification?
No, bismuth articles, waste and scrap fall outside the BIS Quality Control Order regime.
