Compliance steps
  1. 1
Obtain a Pre-Shipment Inspection Certificate from a DGFT-recognised Pre-Shipment Inspection Agency. The PSIC must be generated online through the DGFT website (mandatory from 1 July 2022 per DGFT Trade Notice 03/2022-23 dated 26-04-2022); PSICs dated on or after 1 July 2022 that are not generated through the DGFT online system will not be accepted by Indian Customs. Upload the PSIC in e-Sanchit under document code 856001 before filing the bill of entry.

  2. 2
Confirm the consignment complies with Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016, and submit valid Forms 2, 6, 7 and 9 as required under Schedules III, VI and VIII of those Rules. Ensure compliance with Para 8(B) of the General Notes regarding import policy of the ITC (HS) for waste consignments.

Route the consignment only through specified ports and locations notified under Para 2.54 of the HBP, and confirm compliance with the radioactive-contamination random-checking SOP per the Annexure to DGFT Public Notice 37/2015-20 dated 15-11-2021. For imports from safe countries or regions through specified ports, the PSIC requirement is waived under DGFT Public Notice 64/2015-20 dated 19-02-2020.

A word of counsel

The most common error on this tariff line is shipping un-shredded cobalt scrap (HMS-I and HMS-II grades) without verifying the separate procedural requirements governing non-shredded material under DGFT Public Notice 38/2015-2020 dated 06-10-2016 and its corrigendum Public Notice 40/2015-2020 dated 25-10-2016. The shredded and non-shredded PSIC regimes carry distinct inspection-agency obligations; a PSIC drawn under the wrong procedure is treated as non-compliant and the consignment will be detained at the port, attracting demurrage and potential confiscation under the Customs Act, 1962.

Frequently asked
Does HSN 8105 30 00 require BIS certification?
No, cobalt waste and scrap falls outside the BIS Quality Control Order regime; no BIS QCO covers this product family. Import is governed by the ITC (HS) Restricted policy administered by the Directorate General of Foreign Trade under Para 2.54 of the Handbook of Procedures, with a mandatory DGFT-portal-generated PSIC and Hazardous Waste Rules compliance overlay.
Is the PSIC requirement waived for imports from any country or origin?
Yes, imports from safe countries or regions are exempt from the PSIC requirement provided they arrive through specified ports, per DGFT Public Notice 64/2015-20 dated 19-02-2020; the safe-country list and specified-port list should be verified against the current DGFT notifications before shipment.
What happens if the Hazardous Waste forms are not submitted at the bill of entry?
Failure to submit valid Forms 2, 6, 7 and 9 under the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 constitutes non-compliance with Para 8(B) of the ITC (HS) General Notes, exposing the consignment to detention, refusal of out-of-charge, and potential seizure under the Customs Act, 1962.
