HSN 8104 20 90 (Magnesium waste and scrap — other) is classified as Restricted under the ITC (HS) import policy administered by the Directorate General of Foreign Trade (DGFT), requiring a Pre-Shipment Inspection Certificate (PSIC) generated through the DGFT online portal and clearance only at specified ports or locations. The most common error on this tariff line is assuming the PSIC safe-country exemption eliminates all documentation requirements. The exemption removes only the PSIC; the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 Forms 2, 6, 7 and 9 remain mandatory regardless of origin, and a consignment arriving at a specified port without those Forms is liable to detention pending CPCB/State PCB authorisation. The distinction between shredded and un-shredded scrap (HMS-I and HMS-II) also affects the procedural track under DGFT Public Notice 38/2015-20 and its corrigendum Public Notice 40/2015-20.
