HSN 8104 20 10 (Magnesium scrap) is subject to import-policy controls administered by the Directorate General of Foreign Trade (DGFT) under the ITC (HS) import policy, including a mandatory Pre-Shipment Inspection Certificate (PSIC) generated through the DGFT online portal for metal scrap. Clearance is permitted only at specified ports and locations under Para 2.54 of the Handbook of Procedures, with additional compliance required under Rules 11, 12 and 13 of the Hazardous Waste (Management and Transboundary Movement) Rules, 2016.

The most common error on this tariff line is assuming that compliance with the PSIC requirement alone satisfies clearance. Magnesium scrap also triggers the Hazardous Waste (Management and Transboundary Movement) Rules, 2016 overlay — Forms 2, 6, 7 and 9 under Schedules III, VI and VIII are independently mandatory and their absence causes detention at the port regardless of a valid PSIC upload. For un-shredded scrap (HMS-I and HMS-II), the additional procedure under DGFT Public Notice 38/2015-2020 and its corrigendum PN 40/2015-2020 applies in parallel.
